Title
TO AUTHORIZE THE MAYOR TO ENTER INTO CONTRACT WITH RAYMOND J. MULARSKI FOR PROSECUTION OF CERTAIN CASES RESULTING FROM GAHANNA MAYOR'S COURT AND MAYOR'S DOWNTOWN CASES; AND TO DECLARE AN EMERGENCY.

WHEREAS, the contract of the City Prosecutor expired on December 31, 2013 and it is the recommendation of the City Attorney to renew said contract; and
 
WHEREAS, Mayor's Court is a necessary function of our City Government, and it is deemed appropriate to proceed to effect continuity in said prosecution of Mayor's Court cases, all for the accountability of Mayor's Court; and
 
WHEREAS, it is the desire of the City Attorney to put this contract into effect as soon as possible for the continued smooth operation of the Mayor's Court, and all for the preservation of the public peace, property, health, safety and welfare;
 
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
 
Section 1.  That the Mayor is hereby authorized to enter into Contract of City Prosecutor with Raymond J. Mularski for prosecution of certain cases in Gahanna Mayor's Court and downtown, said contract attached to this legislation as EXHIBIT A, and made a part herein.
 
Section 2.  That the Contract is effective retroactive to January 1, 2014.
 
Section 3.  That funding in the amount of ONE HUNDRED TWENTY THOUSAND DOLLARS ($120,000) was set aside in the Year 2014 Appropriations to Account 101.181.5233, City Attorney, Prosecutor, to cover the herein costs.
 
Section 4.  That, for the reasons set forth in the preamble hereinabove, this ordinance is declared emergency legislation and shall be in full force and effect after passage by this Council and immediately after date of signature approval by the Mayor.
