A RESOLUTION AUTHORIZING THE CITY ATTORNEY TO ENTER INTO THE SECONDARY MANUFACTURERS SETTLEMENTS
BODY
A RESOLUTION AUTHORIZING the City Attorney to execute the Participation Form for the Secondary Manufacturers Settlements, a new national opioid settlement subject to OneOhio.
WHEREAS, the State of Ohio has developed the OneOhio plan, a mechanism to ensure that money from negotiated settlements with distributors of opioids is distributed fairly to communities hit hardest by the opioid crisis; and;
WHEREAS, the settlement agreement allocates 30 percent to local governments, 55 percent to a foundation that will distribute funds to projects, and 15 percent to the Office of the Ohio Attorney General as Counsel for the State of Ohio; and
WHEREAS, the Gahanna City Council passed RES-0028-2021 on August 9, 2021, to accept the material terms of the OneOhio settlement pursuant to the Memorandum of Understanding and consistent with the terms of the July 21, 2021, National Opioid Settlement agreement; and
WHEREAS, there is a new national opioid settlement with Alvogen, Amneal, Apotex, Hikma, Indivior, Mylan, Sun, and Zydus (“Secondary Manufacturers Settlements”) which requires the execution of a Participation Form (Attachment A) in order to receive our eligible allocation of funds; and
WHEREAS, this City Council wishes to participate in the Secondary Manufacturers Settlements and receive the eligible funds.
NOW THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF GAHANNA, COUNTY OF FRANKLIN, STATE OF OHIO:
Section 1. That this City Council hereby authorizes the City Attorney to participate in the Secondary Manufacturers Settlements and to execute any documentation necessary to effectuate this Resolution, including but not limited to Attachment A.
Section 2. That this Resolution shall be in full force and effect after passage by this Council and on date of signature approval by the Mayor.
