WHEREAS, right of way is needed for the US 62/Stygler Road intersection project and settlement has been reached with the property owners; and
 
WHEREAS, it is imperative to move forward with this Settlement so that payment can be made to the property owner this year, and all for the preservation of the public peace, property, health, safety and welfare;
 
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
 
Section 1.  That the Mayor is hereby authorized to enter into Settlement with TIM DONUT US LIMITED, INC., 4150 Tuller Road, Suite 236, Dublin, Ohio 43017, for right of way needed for the US 62/Stygler Road intersection improvement project; Improvement No. 935; Contract of Sale and Purchase  attached as EXHIBIT A and made a part herein.
 
Section 2.  That funding in the amount of THREE THOUSAND THREE HUNDRED AND ELEVEN DOLLARS ($3,311) was set aside in the 2010 Appropriations to Account No. 325.122.5513, Capital Projects-Streets, to cover the herein costs.
 
Section 3.  That, for the reasons set forth in the preamble herein above, this ordinance is declared emergency legislation and shall be in full force and effect immediately upon passage by this Council and on date of signature approval by the Mayor.
