TO ENACT CODE CHAPTER 908, SIDEWALK DINING, AND NON-PERMANENT AMENITIES INSTALLED WITHIN PUBLIC RIGHT OF WAY, OF THE CODIFIED ORDINANCES OF THE CITY OF GAHANNA; AND TO DECLARE AN EMERGENCY.

WHEREAS, the Director of Public Service and the City Engineer have proposed a new code section that would allow sidewalk dining and non-permanent amenities to be installed in the public right of way; and
WHEREAS, outdoor dining season is upon us and there is a lease application waiting for this code to be enacted; and
WHEREAS, it is imperative to get this code in place as quickly as possible for the benefit of our local businesses, and all for the preservation of the public peace, property, health, safety and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That Chapter 908, Sidewalk Dining, and Non-permanent Amenities Installed Within Public Right of Way, is hereby enacted as set forth in EXHIBIT A, attached hereto and made a part herein.
Section 2. That Title Nine, Streets and Public Services Code, of the Codified Ordinances of the City of Gahanna is hereby amended to reflect this new Chapter.
Section 3. That, for the reasons set forth in the preamble hereinabove, this ordinance is declared emergency legislation and shall be in full force and effect after passage by this Council and on date of signature approval by the Mayor.
