TITLE
AN ORDINANCE AUTHORIZING THE CITY ATTORNEY OR THE CITY ATTORNEY’S DESIGNEE TO FILE FOR APPROPRIATION OF RIGHT-OF-WAY AND TEMPORARY CONSTRUCTION EASEMENT AT 926 TAYLOR STATION ROAD; VANDELAY IMPORTS & EXPORTS, LLC, OWNER; IN FURTHERANCE OF THE TAYLOR STATION AND CLAYCRAFT ROAD ROUNDABOUT PROJECT
BODY
WHEREAS, RES-0026-2023 declared the necessity and intent to appropriate certain real estate for right-of-way and temporary construction easements for parcels adjoining the Taylor Station and Claycraft Road intersection improvements and roundabout construction project; and
WHEREAS, the City has not reached a settlement agreement with Vandelay Imports & Exports, LLC, property owner for 926 Taylor Station Road, regarding the right-of-way and temporary construction easements; and
WHEREAS, the right-of-way and temporary construction easements must be obtained before construction can begin on the Taylor Station and Claycraft Road improvement project.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, COUNTY OF FRANKLIN, STATE OF OHIO:
Section 1. That the City Attorney or the City Attorney’s designee is hereby authorized to file in a court of competent jurisdiction for appropriation for right-of-way and construction easement in furtherance of the Taylor Station and Claycraft Road roundabout project for property located at 926 Taylor Station Road; Vandelay Imports & Exports, LLC, owner; said property more particularly described in EXHIBITS A & B, attached hereto and made a part herein.
Section 2. That this Ordinance shall be in full force and effect upon passage by this Council and on date of signature of approval by the Mayor.
