TO AUTHORIZE THE MAYOR TO ENTER INTO OPTICAL FIBER USE AGREEMENT BETWEEN THE GAHANNA-JEFFERSON CITY SCHOOL DISTRICT AND THE CITY OF GAHANNA; AND TO DECLARE AN EMERGENCY

WHEREAS, ORD-0199-2010 authorized the Mayor to enter into Optical Fiber Use Agreement with the Gahanna-Jefferson City School District; and
WHEREAS, additional fiber has been requested as well as allowing the city to collect maintenance fees associated with maintaining the fiber and conduit system and collect the pro-rata share of bonding costs associated with some of the fiber being used by the school district; and
WHEREAS, a new agreement is required in order to meet the additional needs of the school district; and
WHEREAS, it is imperative to move forward with this ordinance so that the City can receive payment for maintaining the fiber as soon as possible, and all for the preservation of the public peace, property, health, safety and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the Mayor is hereby authorized to enter into OPTICAL FIBER USE AGREEMENT with the Gahanna-Jefferson City School District, 160 South Hamilton Road; Agreement attached as EXHIBIT A, and made a part herein.
Section 2. That this agreement rescinds any previous agreement that may have been in place.
Section 3. That, for the reasons set forth in the preamble hereinabove, this ordinance is declared emergency legislation and shall be in full force and effect after passage by this Council and on date of signature approval by the Mayor.
