TO AUTHORIZE THE MAYOR TO ENTER INTO AGREEMENT WITH BASIC RAILROAD SERVICES, INC., FOR MAINTENANCE OF THE GAHANNA RAIL SPUR; TO SUPPLEMENTALLY APPROPRIATE $8,300 THEREFOR; AND TO DECLARE AN EMERGENCY

WHEREAS, the Gahanna rail spur is used and maintained from the main line to the lumber yard, which is less than half of the spur; and
WHEREAS, the portion which extends west to the Magna Quad Building has not been used for years and has not been maintained; and
WHEREAS, since the annual maintenance account has been just sufficient to maintain the portion which is currently used, and
WHEREAS, a tenant has been found for the Magna Quad building and is requesting rail service; and
WHEREAS, since the track is in good shape, it is prudent and necessary to do further maintenance on the portion to the west serving the Magna Quad Building; and
WHEREAS, the new tenant wants to start use of the rail in March, it is necessary to proceed at the earliest possible date to repair this spur and to avoid a derailment, all for the preservation of the public peace, health, safety, and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the Mayor is authorized to enter into Agreement with Basic Railroad SErvices, Inc., P. O. Box 676, Sunbury, OH 43074 for railroad track repairs in accordance with letter proposal dated February 5, 1998, and in accordance with City specifications.
Section 2. That the amount of Eight Thousand Three Hundred Dollars ($8,300) is hereby supplementally appropriated from the unencumbered, unappropriated balance in The General Fund to Account No. 101.145.5444, Railroad Maintenance, to cover the herein costs.
Section 3. That Ordinance No. 980001, passed January 2, 1998, is hereby amended to reflect this supplemental appropriation.
