TO REPEAL CHAPTER 914, TREE REPLACEMENT, OF THE CODIFIED ORDINANCES OF THE CITY OF GAHANNA; AND TO DECLARE AN EMERGENCY

WHEREAS, Chapter 914, Tree Replacement of the codified ordinances of the City of Gahanna was enacted by ORD-0148-2010; and
WHEREAS, the City Attorney has reviewed Chapter 914 at the request of the Director of Parks & Recreation; and
WHEREAS, it has been determined that flaws exist in the wording of this chapter which would create issues with enforcement; and
WHEREAS, to reduce the negative impact on development until this chapter is replaced, it is necessary to accomplish this as soon as possible, all for the preservation of the public peace, property, health, safety and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That Chapter 914, Tree Replacement, is hereby repealed, said Chapter 914 attached hereto as Exhibit A and made a part herein.
Section 2. That, for the reasons set forth in the preamble hereinabove, this ordinance is declared emergency legislation and shall be in full force and effect after passage by this Council and on date of signature approval by the Mayor.
