TITLE
AN ORDINANCE ACCEPTING AN ACCESS EASEMENT AGREEMENT FOR 135 SERRAN DRIVE TO PROVIDE CITY ACCESS TO EXISTING SANITARY SEWER INFRASTRUCTURE; AND DECLARING AN EMERGENCY
BODY
WHEREAS, the City of Gahanna owns and operates public sanitary sewer infrastructure located within the rear yard of the property known as 135 Serran Drive; and
WHEREAS, the City has determined that the sanitary sewer infrastructure requires periodic inspection, repair, and maintenance activities which necessitate access by City personnel, agents, and contractors; and
WHEREAS, during the design review process, it was discovered that the original subdivision plat did not include an access easement over the property at 135 Serran Drive for maintenance of said infrastructure; and
WHEREAS, the property owner of 135 Serran Drive has granted the City an Access Easement Agreement permitting ingress and egress for the purpose of inspection, repair, replacement, and maintenance of the sanitary sewer facilities; and
WHEREAS, it is in the best interest of the City to formally accept said easement to ensure continued operation and maintenance of the public sanitary sewer system; and
WHEREAS, the Administration recommends passage of this Ordinance as an emergency measure necessary for the immediate preservation of the public peace, property, health, safety, and welfare of the City of Gahanna; to wit: the grantors are awaiting approval of the easement prior to placing their home on the market, and a miscommunication regarding the timing of this process necessitates immediate action.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, COUNTY OF FRANKLIN, STATE OF OHIO, THAT:
Section 1.
