TO AUTHORIZE THE MAYOR TO ENTER INTO COOPERATIVE AGREEMENT WITH FRANKLIN COUNTY FOR CONSTRUCTION OF A PORTION OF HAMILTON ROAD BETWEEN CLARK STATE ROAD AND JOHNSTOWN ROAD/U.S. ROUTE 62 PROJECT IN THE JURISDICTION OF THE CITY OF GAHANNA; AND TO DECLARE AN EMERGENCY.

WHEREAS, Hamilton Road between Clark State Road and Johnstown Road/U.S. 62 has utility to the general public of Franklin County as well as to the citizens of the City of Gahanna, is an important roadway on the county and municipal highway system for through traffic, and the public interest demands its rehabilitation; and

 

WHEREAS, Franklin County through the County Engineer, and the City of Gahanna, through its Mayor, do hereby mutually agree to cooperate in the planning, design and construction of the project; and

 

WHEREAS, it has been determined that the general scope of the project will include the widening of Hamilton Road between Clark State Road and Johnstown Road/U.S. 62 along with the miscellaneous work required for the improvement; and

 

WHEREAS, it is imperative to move forward with the agreement all for the preservation of the public peace, health, safety and welfare;

 

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:  

 

Section 1.  That the Mayor is hereby authorized to enter into Cooperative Agreement between Franklin County and the City of Gahanna, said agreement attached hereto as EXHIBIT A, and made a part herein.

 

Section 2.  That the City of Gahanna declares the improvement necessary.

 

Section 3.  That, for the reasons set forth in the preamble hereinabove, this ordinance is declared emergency legislation and shall be in full force and effect immediately upon passage by this Council and on date of signature approval by the Mayor.
