TO AUTHORIZE A REFUND TO MICHAEL FROHNAUER, 436 WEST JOHNSTOWN ROAD, FOR A PORTION OF HIS SEWER TAP FEES; TO SUPPLEMENTALLY APPROPRIATE $1,425; AND TO DECLARE AN EMERGENCY.

WHEREAS, Michael Frohnauer, 436 W. Johnstown Rd. entered into a contract to tap into the city's sewer system as a result of a request from the Franklin County Board of Health; and
WHEREAS, the work could not be done in 2005, and Mr. Frohnauer and his contractor were not aware of the substantial increase in price to do the project in 2006; and
WHEREAS, this will be an environmental improvement to our community; and
WHEREAS, it is imperative to move forward with this refund all for the preservation of the public peace, health, safety and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That funding in the amount of ONE THOUSAND FOUR HUNDRED TWENTY FIVE DOLLARS ($1,425) is hereby supplementally appropriated from the unencumbered, unappropriated balance of the SSCI fund to Account No. 662.361.5474, to cover the herein cost.
Section 2. That the refund of $1,425 is hereby granted to Michael Frohnauer, 436 West Johnstown Road for a portion of his sewer tap fees.
Section 3. That ORD-0001-2006, passed January 2, 2006, is hereby amended to reflect this supplemental appropriation.
Section 4. That, for the reasons set forth in the preamble herein above, this ordinance is declared emergency legislation and shall be in full force and effect immediately upon passage by this Council and on date of signature approval by the Mayor.
