TO AUTHORIZE THE DIRECTOR OF PUBLIC SERVICE TO AWARD AND THE MAYOR TO ENTER INTO CONTRACT WITH SHELLY & SANDS, INC., FOR THE 2006 CONCRETE STREET REPAIR PROGRAM; IMPROVEMENT NO. 890; AND TO DECLARE AN EMERGENCY.

WHEREAS, bids were opened on May 19, 2006, pursuant to Council authorization, and the best, most responsible and responsive bidder has been recommended by the City Engineer; and
WHEREAS, it is imperative to move forward with this ordinance so that work can be completed this summer, all for the preservation of the public peace, health, safety and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the Director of Public Service is hereby authorized to award and the Mayor to enter into contract with SHELLY & SANDS, INC., 1515 Harmon Avenue, Columbus, Ohio 43223, for the 2006 Concrete Street Repair Program, Improvement No. 890, in accordance with bid and City specifications; bid tabs attached as EXHIBIT A.
Section 2. That funding in the amount of ONE HUNDRED TEN THOUSAND DOLLARS ($110,000) was set aside in the 2006 Appropriations to Account No. 101.145.5541, Engineering, Streets, to cover the herein costs,
Section 3. That funding in the amount of ONE HUNDRED EIGHTY FIVE THOUSAND EIGHT HUNDRED FORTY NINE DOLLARS ($185,849) was set aside in the 2006 Appropriations to Account No. 325.122.5548, Capital Improvements, to further cover the herein costs.
Section 4. That, for the reasons set forth in the preamble herein above, this ordinance is declared emergency legislation and shall be in full force and effect immediately upon passage by this Council and on date of signature approval by the Mayor.
