TO ZONE 30.377+/- ACRES, MORE OR LESS, AS L-AR, LIMITED OVERLAY APARTMENT RESIDENTIAL; FOR PROPERTY LOCATED AT 5099-5145 MORSE ROAD; TRIANGLE REAL ESTATE SERVICES, APPLICANT

 

Body

WHEREAS, application has been made by Triangle Real Estate Services to zone 30.377+/- acres as L-AR, Limitd Overlay Apartment Residential in order to construct a combination of senior condominiums, ranch condominiums and apartments, said property located at 5099-5145 Morse Road; and

 

WHEREAS, Planning Commission held public hearing, said hearing held pursuant to notice and acording to law and, as a result of such hearing and deliberations, on July 12, 2000 Planning Commission recommended this application for zoning; and

 

WHEREAS, Council held Public Hearing on August 21, 2000, pursuant to notice and according to law;

 

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:

 

Section 1.  That the Official Zoning Map, adopted by Ordinance No. 198-96 on November 19, 1996, as amended, is hereby amended by zoning 30.377+/- acres, more or less, to L-AR, Limited Overlay Apartment Residential, said acreage more particularly described in EXHIBIT A attached hereto.

 

Section 2.  That the text and site plan as required by Section 1152.02, Limited Overlay District, is attached to this ordinance as EXHIBIT B.

 

Section 3.  That the public areas dedication required under Section 1109.08 shall be in the form of park land dedication and shall follow the procedure outlined in Section 1109.08 (h)(i) & (j) of the Codified Ordinances.

 

Section 4.  That the Clerk of Council is hereby directed to amend and recertify the Official Zoning Map of the City of Gahanna, Ohio, to reflect the zoning contained in and approved by this ordinance.

 

Section 5.  That this ordinance shall be in full force and effect at the earliest period allowed by law.
