TO AUTHORIZE THE MAYOR TO EXECUTE ENCROACHMENT EASEMENT FOR PROPERTY LOCATED AT 73-77 MILL STREET TO LEGALLY PERMIT RIGHT-OF-WAY ENCROACHMENT; AND TO DECLARE AN EMERGENCY.

WHEREAS, the property owner at 73-77 Mill Street is in the process of redeveloping and redesigning the building and expanding it, and a portion will encroach on the public right of way on Mill Street; and
WHEREAS, the City has determined that the easement area is an acceptable improvement to the downtown area and is agreeable to granting this encroachment; and
WHEREAS, Planning Commission did approve a variance required to allow the expansion of the non-conforming building at the January 23, 2013 meeting;
WHEREAS, it is imperative to move forward with this easement as construction on the building at 73-77 Mill Street has been halted until this encroachment easement is in place, and all for the preservation of the public peace, property, health, safety and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the Mayor is hereby authorized to execute Encroachment Easement for the property at 73-77 Mill Street to legally permit encroachment on the City right-of-way; Encroachment Easement attached as EXHIBIT A, and made a part herein.
Section 2. That, for the reasons set forth in the preamble hereinabove, this ordinance is declared emergency legislation and shall be in full force and effect immediately upon passage by this Council and on date of signature approval by the Mayor.
