TO ACCEPT DEED OF EASEMENT FOR SANITARY SEWER AND OTHER PUBLIC UTILITIES FOR APARTMENTS LOCATED ON SHORT STREET AND WALNUT STREETS AND NOW KNOWN AS JEFFERSON WOODS; FROM THE GAHANNA INVESTMENT AND REALTY COMPANY.

WHEREAS, an easement for construction, using and maintaining a sanitary sewer was obtained in 1961 from The Gahanna Investment and Realty Company; and
WHEREAS, said utility easement was recorded on March 29, 1961 by the Franklin County Recorder's Office; and
WHEREAS, said utility easement was never accepted by the City of Gahanna;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That this Council hereby accepts the Deed of Easement from the Gahanna Investment and Realty Company, for sanitary sewer and other public utilities for apartments now known as Jefferson Woods and located on Short Street and Walnut Street, said land more particularly described in EXHIBIT A attached hereto and made a part herein.
Section 2. That this ordinance shall be in full force and effect at the earliest period allowed by law.
