TO AUTHORIZE THE MAYOR TO ENTER INTO CONTRACT FOR PURCHASE OF 0.363 ACRES ON SOUTH STYGLER ROAD AND WEST JOHNSTOWN ROAD FOR RIGHT OF WAY PURPOSES; OWNED BY GC HOLDINGS; TO SUPPLEMENTALLY APPROPRIATE $112,549; AND TO DECLARE AN EMERGENCY.

WHEREAS, GC Holdings has purchased a property on South Stygler Road of which a portion is needed for right of way purposes; and

 

WHEREAS, GC Holdings is willing to sell the needed right of way to the City of Gahanna; and

 

WHEREAS, it is prudent to proceed to authorize the purchase of this property at this time for the continuation of the orderly redevelopment of the west side and the Stygler Road/Route 62 intersection, all for the preservation of the public peace, health, safety, and welfare;

 

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:

 

Section 1.  That the Mayor is hereby authorized to enter into Real Estate Purchase Contract, said document attached hereto as EXHIBIT A.

 

Section 2.  That a legal description and survey of the property being purchased is attached hereto as EXHIBIT B.

 

Section 3.  That the amount of ONE HUNDRED TWELVE THOUSAND FIVE HUNDRED FORTY NINE DOLLARS ($112,549) is hereby supplementally appropriated from the unappropriated, unencumbered balance in the general fund to Account No. 101.343.5511, Captial Projects, Development.

 

Section 4.  That ORD-0001-2001, passed January 2, 2001, is hereby amended to reflect the herein supplemental appropriation.

 

Section 5.  That, for the reasons set forth in the preamble herein above, this ordinance is declared emergency legislation and shall be in full force and effect after passage by this Council and on date of signature approval by the Mayor.
