TO AUTHORIZE THE CITY ATTORNEY OR HIS DESIGNEE TO FILE AN ANNEXATION PETITION FOR THE ANNEXATION OF 6.3+/- ACRES OF PROPERTY FROM JEFFERSON TOWNSHIP; SAID PROPERTY LOCATED AT 3891 CLOTTS ROAD, BILLY G. AND VANIETA B. DECKER, OWNERS; AND TO DECLARE AN EMERGENCY.

WHEREAS, Billy G. and Vanieta B. Decker granted an easement across their property to alleviate water issues in the Old Mill subdivision and to allow construction of the Hamilton Parke subdivision; and

 

WHEREAS, the Deckers wish to tap into this waterline and in order to do so the property must be annexed to the City; and

 

WHEREAS, a legal description has been developed and it is necessary to proceed at the earliest possible date to annex this parcel so the Deckers can receive water service; and

 

WHEREAS, Section 709 of the Ohio Revised Code requires that a representative be appointed by the City to prosecute proceedings; and

 

WHEREAS, it is imperative to move forward so that this property can be part of the City of Gahanna as soon as possible, all for the preservation of the public peace, health, safety and welfare;

 

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:

 

Section 1.  That it is necessary and in the best interest of the City of Gahanna to annex said 6.3+/- acres located at 3891 Clotts Road; said acreage more particularly described in EXHIBIT A, attached to this ordinance and made a part herein.

 

Section 2.  That the City Attorney or his designee is authorized and directed to effect all documentation necessary for the completion of this annexation before the Board of County Commissioners of Franklin County, Ohio.

 

Section 3.  That, for the reasons set forth in the preamble hereinabove, this ordinance is declared emergency legislation and shall be in full force and effect immediately upon passage by this Council and on date of signature approval by the Mayor.
