TO AUTHORIZE THE MAYOR TO GRANT EASEMENT AND RIGHT OF WAY TO AMERICAN ELECTRIC POWER OHIO, FOR LOT 9 OF THE INDUSTRIAL ZONE, FOR UTILITY EASEMENT AND RIGHT OF WAY; AND TO DECLARE AN EMERGENCY.

WHEREAS, A.E.P. needs to upgrade service to Donatos, Lot 9 of the Industrial Zone, and it is necessary for the Mayor to execute the easement since the City owns the land; and
WHEREAS, it is imperative to move forward with this ordinance so that the work can be done during the construction season, all for the preservation of the public peace, health, safety and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the Mayor is hereby authorized to grant Easement and Right of Way to American Electric Power Ohio, for utility work for upgrade of services for Lot 9 of the Industrial Zone; said Easement and Right of Way description attached as EXHIBIT A and made a part herein.
Section 2. That, for the reasons set forth in the preamble herein above, this ordinance is declared emergency legislation and shall be in full force and effect immediately upon passage by this Council and on date of signature approval by the Mayor.
