TO AUTHORIZE THE MAYOR TO SIGN LETTER OF ENGAGEMENT FOR REFUSE CONSORTIUM REPRESENTATION BY EASTMAN & SMITH, LTD.

WHEREAS, the City is a member of a Solid Waste Consortium that includes several other communities, and the consortium has reason to believe that we may obtain a better price if we rebid the contract in 2014; and
WHEREAS, The Solid Waste Authority (SWACO) initiated the concept of a refuse consortium and has always supplied the legal support of Eastman & Smith, Ltd. to advise and facilitate the formal bid; and
WHEREAS, even though SWACO pays Eastman & Smith, each community in the consortium is asked to execute Letter of Engagement for representation; and
WHEREAS, this Letter of Engagement does not bind Gahanna financially unless we would choose to utilize Eastman & Smith for work specific to the City of Gahanna that does not benefit the consortium, and it is not our intent to use them at all;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the Mayor is hereby authorized to sign Letter of Engagement with EASTMAN & SMITH, LTD., 100 East Broad Street, Columbus, Ohio 43215, for representation and to advise the SWACO refuse consortium and facilitate any formal bid process; said Letter of Agreement attached hereto as EXHIBIT A, and made a part herein.
Section 2. That this ordinance shall be in full force and effect after passage by this Council and 30 days after date of signature approval by the Mayor.
