WHEREAS, in accordance with Section 1105.07 of the Codified Ordinances of the City of Gahanna, the City Engineer has certified in writing that the improvements of the waterline, street, and storm sewer, Improvement No. 731; and sanitary sewer, Improvement No. 732; and appurtenances thereto, in   "Villages at Rocky Fork", Harrison Pond, Section 11, Phase l, are completed and approved or that a bond or other surety has been furnished assuring construction and initial maintenance of all required improvements; and

 

WHEREAS, the immediate acceptance of these improvements is requested and deemed appropriate in order to prevent further delay in the development of this project, all for the preservation of the public peace, health, safety and welfare;

 

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:

 

Section 1.  That the improvements of the waterline, street, and storm sewer, Improvement No. 731, and sanitary sewer, Improvement No. 732, and appurtenances thereto, in Harrison Pond, "The Villages at Rocky Fork", Section 11, Phase 1, are hereby accepted.

 

Section 2.  That, for the reasons set forth in the preamble herein above, this ordinance is declared emergency legislation, and shall be in full force and effect immediately after passage by this Council and upon the date of signature approval by the Mayor.
