STATEMENT OF LEGISLATIVE INTENT AND FINDINGS IN SUPPORT OF ORDINANCE 0034-2013 PENDING FORMAL ADOPTION OF ORDINANCE 0034-2013

WHEREAS, Ordinance 0034-2013, to Amend Section 161.18, Credit for Tax Paid to Another Municipality, of Chapter 161, Income Tax, of the codified ordinances of the City of Gahanna, was introduced on January 22, 2013; and
WHEREAS, pursuant to Section 161.18(a) of the Codified Ordinances of the City of Gahanna, City Council held three (3) public hearings regarding Ordinance 0034-2013 on February 4, 2013, February 19, 2013, and March 4, 2013; and
WHEREAS, pursuant to Section 161.18(a) of the Codified Ordinances of the City of Gahanna, City Council may not make any revisions to Section 161.18(a) of the Codified Ordinances of the City of Gahanna, by formally adopting Ordinance 0034-2013, less than 60 days following the final public hearing held on March 4, 2013; and
WHEREAS, Ordinance 0034-2013 was postponed, on February 4, 2013, until date certain of May 6, 2013; and
WHEREAS, Ordinance 0034-2013 is contingent upon voter approval of Issue 4 on the May 7, 2013 Primary Election ballot, and upon subsequent certification of said approval by the Franklin County Board of Elections;
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1: That the Council of the City of Gahanna finds the results of Public Hearing 2013-0005 to be in support of Ordinance 0034-2013.
Section 2: That the Council of the City of Gahanna intends to vote for the adoption of Ordinance 0034-2013, as introduced on January 22, 2013, at its regular meeting on May 6, 2013.
Section 3: That this resolution shall be in full force and effect at the earliest period allowed by law.
