TO ACCEPT DEED OF EASEMENT IN CHERRY BOTTOM SECTION 2 FOR PUBLIC AND PRIVATE UTILITY PURPOSES; FROM CHERRY BOTTOM DEVELOPMENT COMPANY.

WHEREAS, an easement for construction, operation and maintenance of public and private utilities above and beneath the surface of the ground was obtained in 1979 from Cherry Bottom Development Company; and
WHEREAS, said utility easement was recorded on April 24, 1979 by the Franklin County Recorder's Office; and
WHEREAS, said utility easement was never accepted by the City of Gahanna;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That this Council hereby accepts the Deed of Easement from Equitable Development Corporation, for public and private utility purposes in Cherry Bottom Section2, said land more particularly described in EXHIBIT A attached hereto and made a part herein.
Section 2. That this ordinance shall be in full force and effect at the earliest period allowed by law.
