TO AUTHORIZE THE MAYOR TO EXECUTE EASEMENT WITH RICHARD WINNESTAFFER, 85 SOUTH HIGH STREET, FOR A RECREATIONAL MULTI-USE TRAIL; AND TO DECLARE AN EMERGENCY.

WHEREAS, the City has requested an easement for land for a recreational multi-use trail at 85 S. High Street; and
WHEREAS, the property owner has agreed to grant easement to this property and the City has agreed to purchase said easement for $10,000; and
WHEREAS, it is imperative to move forward so that construction can begin as soon as possible, and all for the preservation of the public peace, health, safety and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the Mayor is hereby authorized to execute easement with Richard Winnestaffer for 1,224 sq. ft. of land at 85 South High Street for use as a recreational multi-use trail; as described in EXHIBIT A, attached and made a part herein.
Section 2. That funding in the amount of TEN THOUSAND DOLLARS ($10,000) was set aside from Bond Proceeds approved by ORD-0095-2007, to Account No. 101.431.5596, Parks Capital Projects/Improvements, to cover the herein costs.
Section 3. That second reading is hereby waived.
Section 4. That, for the reasons set forth in the preamble herein above, this ordinance is declared emergency legislation and shall be in full force and effect immediately upon passage by this Council and on date of signature approval by the Mayor.
