A RESOLUTION OPPOSING THE TAX EXPENDITURE LIMITATION ("TEL") AMENDMENT AND URGING VOTERS OF THE STATE OF OHIO TO VOTE "NO" ON THE TEL AMENDMENT AT THE NOVEMBER 7, 2006 GENERAL ELECTION.

WHEREAS, there will be a proposed amendment to Section 14, Article XII of the Ohio Constitution on the statewide ballot at the November 7, 2006 general election; and
WHEREAS, this proposed Amendment to the constitution is commonly referred to as the Tax Expenditure Limitation ("TEL") or the Taxpayer Bill of Rights ("TABOR") Amendment; and
WHEREAS, an analysis of the proposal indicates that it will destroy municipal budgeting across the State of Ohio and will cripple the ability of municipalities to provide everyday, essential services upon which our citizens depend; and
WHEREAS, the TEL proposal caps all local government expenditures at the rate of the population growth, plus the rate of the consumer price index of 3.5% per year which will be devastating to local services, such as fire and police protection, education, mental health, and parks and recreation; and
WHEREAS, such proposals would force the state, and local governments, to spend valuable time and money asking for permission from the same people who elected them before any action can be taken on important issues, and would also force taxpayers to pay twice for governance - once for elections of their state and local officials and again for the elections to make the decisions those official should have made; and
WHEREAS, such proposals contradict the fundamental principles upon which our Constitution and system of representative government are based and damages the ability to craft good public policy;
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
