TO AUTHORIZE THE MAYOR TO EXECUTE EASEMENT FOR AMERITECH NON EXCLUSIVE EASEMENT FOR TELEPHONE EQUIPMENT ON CITY PROPERTY ON NORTH HAMILTON ROAD NEAR VISTA DRIVE; TO REPEAL ORDINANCE ORD-0181-2000; TO WAIVE SECOND READING; AND TO DECLARE AN EMERGENCY

WHEREAS, Ameritech has requested easement through City property on North Hamilton Road near Vista Drive; and
WHEREAS, the City Engineer has asked that we move forward to execute this easement; and
WHEREAS, ORD-0181-2000 was passed granting an exclusive easement to Ameritech and they have agreed to a non exclusive easement; and
WHEREAS, it is in the best interest of the City to move forward as quickly as possible for this work to be completed, all for the preservation of the public peace, health, safety and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the Mayor is hereby authorized to execute Ameritech Non Exclusive Easement, to allow for telephone equipment on City property on North Hamilton Road near Vista Drive.
Section 2. That ORD-0181-2000 is hereby repealed.
Section 3. That second reading of this ordinance is hereby waived.
Section 4. That for the reasons set forth in the preamble hereinabove, this ordinance is declared emergency legislation and shall be in full force and effect after passage by this Council and on date of signature approval by the Mayor.
