TO VACATE A PORTION OF TECHCENTER DRIVE AS PUBLIC ROADWAY WITH UTILITY EASEMENTS TO BE MAINTAINED; FOR 0.096 ACRES LOCATED AT 825 TECHCENTER DRIVE; AND TO DECLARE AN EMERGENCY

WHEREAS, the extension of TechCenter Drive eastward has been approved, making the cul-de-sac bulb no longer necessary at this location; and
WHEREAS, the Planning Commission has reviewed this request and at their regular meeting held February 13, 2008 recommended to Council that a portion of TechCenter Drive be vacated as public roadway except that utility easements be maintained; and
WHEREAS, the City Engineer has stated that this portion of TechCenter Drive could be vacated as a public roadway except for utility easements; and
WHEREAS, it is imperative to move forward with this project for the upcoming construction season; and all for the preservation of the public peace, health, safety and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That a 0.096 acre portion of TechCenter Drive, more particularly described in EXHIBIT A, shall be vacated.
Section 2. That a general utility easement in, over, on, across, under, and through the above described right-of-way be and hereby is retained unto the City of Gahanna.
Section 3. That, for the reasons set forth in the preamble hereinabove, this ordinance shall be declared emergency legislation and shall be in full force and effect immediately upon passage by this Council and signature of approval by the Mayor.
