Title

 

TO AUTHORIZE THE MAYOR TO ENTER INTO AGREEMENT WITH THE OHIO DEPARTMENT OF TRANSPORTATION FOR ACQUISITION OF RIGHT OF WAY ALONG MORSE ROAD; TO SUPPLEMENTALLY APPROPRIATE $37,700 THEREFOR; AND TO DECLARE AN EMERGENCY.

 

Body

 

WHEREAS, Ordinance 280-93 provided for cooperation with the State for Fra Morse Road, State Job. No. 060300, which is the reconstruction of Morse Road to a five lane pavement, inclusive of related water line, storm sewer, lighting and traffic control work; and

 

WHEREAS, the Ohio Department of  Transportation is ready to move ahead with the acquisition of the right of way for this project; and

 

WHEREAS, the City portion of the right of way acquisition now needs to be funded; and

 

WHEREAS, it is imperative that this acquisition be started immediately for the timely advancement of this project, and for the preservation of the public peace, health, safety and welfare:

 

N OW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:

 

Section 1.  That the Mayor is hereby authorized to enter into Real Estate Agreement No. 6003 with the Ohio Department of Transportation, said agreement attached hereto as EXHIBIT A.

 

Section 2.  That Thirty Seven Thousand Seven Hundred Dollars ($37,700) is hereby supplementally appropriated from the unappropriated, unencumbered balance in the General Fund to Account No. 101.145.5541, Capital Projects, Streets, to cover the herein costs.

 

Section 3.  That Ordinance No. 980001, passed January 2, 1998, is hereby amended to reflect this supplemental appropriation.

 

Section 4.  That, for the reasons set forth in the preamble hereinabove, this ordinance is declared emergency legislation and shall be in full force and effect immediately upon passage by this Council and approval by the Mayor.
