TO AMEND CHAPTER 147, BOARD OF ZONING AND BUILDING APPEALS, OF THE CODIFIED ORDINANCES OF GAHANNA, TO DIRECT CERTAIN DOCUMENTATION WITH RELATION TO APPEALS FILED; AND TO DECLARE AN EMERGENCY.

WHEREAS, the City Attorney has recommended certain changes in procedures to be followed by the Board of Zoning and Building Appeals, in order to protect the City's interest should those appeals go forward to Court; and
WHEREAS, due to the potential for appeals coming before the Board of Zoning and Building Appeals soon, it is deemed appropriate and necessary to move forward to effect these changes at the earliest possible date, all for the preservation of the public peace, health, safety, and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That Chapter 147, Board of Zoning and Building Appeals, of the Codified Ordinances of Gahanna is hereby amended as provided in EXHIBIT A, attached to this ordinance and made a part herein.
Section 2. That existing Chapter 147 is hereby repealed.
Section 3. That, for the reasons set forth in the preamble hereinabove, this ordinance is declared emergency legislation and shall be in full force and effect immediately upon passage by this Council and approval by the Mayor.
