TO AUTHORIZE THE MAYOR TO EXECUTE STORMWATER MANAGEMENT EASEMENT TO CONTINENTAL/EAGLE IV, LLC IN ORDER TO USE THE NATURAL BASIN FOR STORMWATER MANAGEMENT ON THE GIANT EAGLE PROPERTY; AND TO DECLARE AN EMERGENCY.

WHEREAS, the City has requested that Continental/Eagle IV, LLC, use the natural basin as stormwater management to save trees on the Giant Eagle property; and
WHEREAS, to accomplish this it is necessary to execute a perpetual nonexclusive Storm Basin Easement; and
WHEREAS, it is imperative to move forward with this all for the preservation of the public peace, health, safety and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the Mayor is hereby authorized to execute Storm Basin Easement for stormwater management on the Giant Eagle property; said easement attached hereto as Exhibit A.
Section 2. That upon completion of construction, this stormwater basin will revert back to the City, but must remain as the stormwater basin for Giant Eagle.
Section 3. That, for the reasons stated in the preamble herein above, this ordinance is declared emergency legislation and shall be in full force and effect after passage by this Council and on date of signature approval by the Mayor.
