TO ACCEPT STREET, STORM, AND WATER IMPROVEMENT NO. 791, AND SANITARY SEWER, IMPROVEMENT NO. 792; AND APPURTENANCES THERETO, IN THE WOODMERE PLACE SUBDIVISION, AND TO DECLARE AN EMERGENCY.

WHEREAS, in accordance with Section 1105.07 of the Codified Ordinances of the City of Gahanna, the City Engineer has certified in writing that the improvements of the street, storm and water, Improvement No. 791; and sanitary sewer, Improvement No. 792; and appurtenances thereto, in the Woodmere Place subdivision, are completed and approved or that a bond or other surety has been furnished assuring construction and initial maintenance of all required improvements; and
WHEREAS, at the time the construction drawings were prepared and signed, it was the desire of the previous administration to have a bike path in place of the sidewalks; and
WHEREAS, the immediate acceptance of these improvements is requested and deemed appropriate in order to prevent any further delay in the development of this project, all for the preservation of the public peace, health, safety and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the improvements of the street, storm, and water Improvement No. 791, and Sanitary Sewer, Improvement No. 792, and appurtenances thereto, in the Woodmere Place Subdivision, are hereby accepted.
Section 2. That it is understood with the acceptance of these improvements that sidewalks will be constructed as required by code and that the bike path as shown and signed off on the construction drawings will not be constructed.
Section 3. That, for the reasons set forth in the preamble herein above, this ordinance is declared emergency legislation and shall be in full force and effect after passage by this Council and on date of signature approval by the Mayor.
