TO AUTHORIZE THE MAYOR TO ENTER INTO CONTRACT WITH S. VITALE PYROTECNICO INDUSTRIES INC., FOR FIREWORKS FOR THE CITY OF GAHANNA 2013 FOURTH OF JULY FIREWORKS DISPLAY; TO SUPPLEMENTALLY APPROPRIATE $19,380; AND TO DECLARE AN EMERGENCY.

WHEREAS, it is necessary to enter into contract with S. Vitale Pyrotechnico Industries, Inc. for the 2013 Fireworks show on July 4 and funding was appropriated for this use; and
WHEREAS, it is imperative to move forward with this ordinance as soon as possible to accommodate the contract signing to guarantee the show, and all for the preservation of the public peace, property, health, safety and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the Mayor is hereby authorized to enter into contract with S. VITALE PYROTECNICO INDUSTRIES, INC., P.O. Box 149, New Castle, PA 16103, to furnish and launch fireworks for the Gahanna Freedom Festival; contract attached as EXHIBIT A, and made a part herein.
Section 2. That funding in the amount of NINETEEN THOUSAND THREE HUNDRED EIGHTY DOLLARS ($19,380) was appropriated in the 2013 appropriations to Account No. 101.432.5415, Recreation, Fourth of July, to cover the herein costs.
Section 3. That second reading of this ordinance is hereby waived.
Section 4. That, for the reasons set forth in the preamble hereinabove, this ordinance is declared emergency legislation and shall be in full force and effect immediately upon passage by this Council and on date of signature approval by the Mayor.
