WHEREAS, ORD-0032-2010 through ORD-0036-2010 authorizes the City to appropriate interest in parcels of land located in the proposed area of the Hamilton Road/Granville Street intersection project for right of way purposes, and specialized legal services will be required to move forward; and
 
WHEREAS, the City Attorney and the City Engineer recommend using Craig B. Paynter of Chester, Willcox & Saxbe, to perform this work; and
 
WHEREAS, it is imperative to move forward with this contract as soon as possible so the work on the widening project is not delayed, and all for the preservation of the public peace, property, health, safety and welfare;  
 
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
 
Section 1.  That the Mayor is hereby authorized to enter into contract with Craig B. Paynter, of Chester, Willcox & Saxbe, 65 East State Street, Suite 1000, Columbus OH  43215, for legal services in connection with the Hamilton/Granville Intersection project, Imp. No. 883, for the purposes of acquiring right of way; proposal attached to this ordinance as EXHIBIT A, and made a part herein.
 
Section 2. That funding in the amount of THIRTY THOUSAND DOLLARS ($30,000) is available in Account No. 101.145.5513, Streets/Engineering, to cover the herein costs.
 
Section 3.  That, for the reasons set forth in the preamble herein above, this ordinance is declared emergency legislation and shall be in full force and effect immediately upon passage by this Council and on date of signature approval by the Mayor.
