TO ACCEPT DEED OF EASEMENT FOR SANITARY SEWER IMPROVEMENT IN ROCKY FORK SQUARE ON HAMILTON ROAD; FROM ROCKY FORK SQUARE PARTNERSHIP AND FROM CHESAPEAKE REALTY INC.

WHEREAS, two easements for construction, using and maintaining a sanitary sewer were obtained in 1976 and 1986 from Rocky Fork Square Partnership and Chesapeake Realty Inc.; and
WHEREAS, said utility easements were recorded on February 17, 1976 and July 19, 1986 by the Franklin County Recorder's Office; and
WHEREAS, said utility easements were never accepted by the City of Gahanna;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That this Council hereby accepts the Deeds of Easement from Rocky Fork Square Partnership and Chesapeake Realty Inc., for Sanitary Sewer Improvement in Rocky Fork Square on North Hamilton Road, said land more particularly described in EXHIBIT A and B attached hereto and made a part herein.
Section 2. That this ordinance shall be in full force and effect at the earliest period allowed by law.
