A RESOLUTION PLACING A MORATORIUM ON GAHANNA CITY CODE SECTIONS 780.03 REGISTRATION REQUIRED, 780.04 DESIGNATED AGENT; NOTICE AND SERVICE OF PROCESS, 780.08 FEES AND 780.09 INSPECTIONS; ALSO KNOWN AS THE RENTAL PROPERTY REGISTRATION AND MAINTENANCE CODE.
BODY
WHEREAS, on July 2, 2018, Gahanna City Council passed Ordinance No. 0053-2018, enacting Chapter 780 of the Gahanna Codified Ordinances, known as the Rental Property Registration and Maintenance Code; and
WHEREAS, Governor Mike Dewine has issued Executive Order 2020-01D, declaring a State of Emergency in the State of Ohio as a necessary statewide preventative and proactive measure to slow the spread of Covid-19; and
WHEREAS, on March 23, 2020, Gahanna City Council issued an emergency ordinance, ORD 33-2020, declaring a State of Emergency in the City of Gahanna and empowering the Mayor with extraordinary powers during the State of Emergency; and
WHEREAS, subsequent thereto, Mayor Laurie A. Jadwin issued Proclamation 2020-01, delineating certain changes in the operation of the government of the City of Gahanna; and
WHEREAS, due to the ongoing public health crisis, and in order to also allow the City Administration and City Council the necessary time to enact changes to Chapter 780 to reassess the operations and costs of administering and enforcing said Chapter amongst landlords, based upon the first year of implementation of the Code, the City Council has decided to take certain actions.
NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE CITY OF GAHANNA, COUNTY OF FRANKLIN, STATE OF OHIO:
Section 1. That there shall be a one hundred twenty (120) day moratorium, beginning on the effective date of this Resolution, of the enforcement of Gahanna City Code Sections 780.03 Registration Required, 780.04 Designated Agent; Notice and Service of Process, 780.08 Fees, and 780.09 Inspections.
Section 2. That this Resolution shall be in full force and effect at the earliest period allowed by law.
