TO AUTHORIZE THE DIRECTOR OF PUBLIC SERVICE TO AWARD AND THE MAYOR TO ENTER INTO CONTRACT WITH THE SHELLY COMPANY FOR 1999 ASPHALT OVERLAY, IMPROVEMENT NO. 725; AND TO DECLARE AN EMERGENCY.

WHEREAS, bids were opened on April 23, 1999, pursuant to Council authorization, and the best, responsible, and responsive bidder has been recommended by the Director of Public Service; and
WHEREAS, it is desirable to proceed with this contract at the earliest possible date due to the pending construction season, all for the preservation of the public peace, health, safety, and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the Director of Public Service is authorized to award and the Mayor authorized to enter into contract with THE SHELLY COMPANY, 80 Park Drive, Thornville, Ohio 43078, for the 1999 Asphalt Overlay Program for the City, in accordance with bid and City specifications.
Section 2. That to cover the herein costs, funding in the amount of FOUR HUNDRED TWENTY THOUSAND DOLLARS ($420,000) was set aside in the 1999 Appropriations as follows:
$225,000 - Account No. 220.330.5547, Paving;
$170,000 - Account No. 101.145.5541, Capital Projects, Streets;
$ 25,000 - Account No. 101.343.5511, Capital Projects, Development.
Section 3. That additional funding in the amount of ONE HUNDRED TWENTY-FOUR THOUSAND THREE HUNDRED DOLLARS ($124,300)is hereby supplementally appropriated from THE GENERAL FUND as follows:
$118,349 - To Account No. 101.145.5541, Capital Projects, Streets;
$ 5,951 - To Account No. 101.343.5511, Capital Projects, Development.
Section 4. That, for the reasons set forth in the preamble herein above, this ordinance is declared emergency legislation and shall be in full force and effect immediately upon passage by this Council and approval by the Mayor.
