TO AUTHORIZE THE MAYOR TO ENTER INTO DEVELOPER'S AGREEMENT WITH M. H. MURPHY DEVELOPMENT COMPANY FOR DEVELOPMENT OF THE AMBERLEA VILLAGE CONDOMINIUM PROJECT ON EAST JOHNSTOWN ROAD; TO REPEAL ORD-0193-2003; AND TO DECLARE AN EMERGENCY.

WHEREAS, the development of the tract of land at 4541 East Johnstown Road is a complex matter involving two developers, the extension of Riva Ridge Boulevard and a waterline extension; and

 

WHEREAS, it is deemed appropriate to enter into a Developer's Agreement in order to clarify the numerous issues involved with this development; and

 

WHEREAS, The Development Department has renegotiated with the Murphy Company to enter into a new Developer's Agreement modifying the contract to make the roadway contribution in one lump sum payment rather than graduated; and

 

WHEREAS, ORD-0193-2003 must be repealed so that the Mayor can enter into this new Developer's Agreement;  and

 

WHEREAS, it is imperative to move forward with this immediately so that construction can begin yet this year, all for the preservation of the public peace, health, safety and welfare:

 

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:

 

Section 1.  That the Mayor is hereby authorized to enter into Developer's Agreement with M. H. Murphy Development Company for development of the Amberlea Village Condominium Project at 4541 East Johnstown Road, said Agreement attached hereto as EXHIBIT A and made a part of this ordinance. 

 

Section 2.  That ORD-0193-2003 is hereby repealed.

 

Section 3. That waiver of second reading has been requested.

 

Section 4.  That, for the reasons set forth in the preamble herein above, this ordinance is declared emergency legislation and shall be in full force and effect immediately after passage by this Council and on date of signature approval by the Mayor.
