TO AUTHORIZE THE MAYOR TO EXECUTE A DEED TO PEACE LUTHERAN CHURCH; TO EXCHANGE LAND RESPECTIVELY WHEREBY THE CITY WILL RECEIVE CERTAIN INTEREST IN LAND AT 455 CLARK STATE ROAD, AND THE CHURCH WILL RECEIVE LAND FRONTING ON HAMILTON ROAD FOR A DRIVEWAY TO LINE UP WITH CARPENTER ROAD.

Body

WHEREAS, Peace Lutheran Church is beginning the process of a church expansion at which time they are desirous of having an access on Hamilton Road; and

 

WHEREAS, the City Engineer has stated that any curb cut must line up with  Carpenter Road for traffic management purposes; and

 

WHEREAS, the City Administration has negotiated with Peace Lutheran Church for an exchange of land, to the mutual satisfaction of both entities; and 

 

WHEREAS, the City will deed to the church a 0.398 acre parcel which will allow for the driveway alignment with Carpenter Road; and

 

WHEREAS, in exchange Peace Lutheran Church will give the City a 0.332 acre parcel which is in the flood plain and is contiguous to existing property the City owns in the flood plain; and

 

WHEREAS, Planning Commission has approved a Subdivision Without Plat which is necessary to complete this transaction;

 

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:

 

Section 1.  That the Mayor is hereby authorized to execute a deed to Peace Lutheran Church, 455 Clark State Road, Gahanna, for a 0.398 acre parcel more particularly described in EXHIBIT A, attached and made a part of this ordinance; and to execute any other documents necessary to complete this agreement.

 

Section 2.  That the City will receive a 0.332 acre parcel in exchange, as shown and more particularly described in EXHIBIT B, attached and made a part of this ordinance.

 

Section 3.  That this ordinance shall be in full force and effect after passage by this Council and 30 days after date of signature by the Mayor.
