TO AUTHORIZE THE MAYOR TO ENTER INTO CONTRACT WITH MS CONSULTANTS, INC., FOR DESIGN MODIFICATIONS OF HAMILTON ROAD CENTRAL, IMP. NO. ST785; AND TO DECLARE AN EMERGENCY.

WHEREAS,we have been working with the Franklin County Engineer on this project for many years and the design work has been ongoing since mid 2011 under authority of ORD-0127-2011; and
WHEREAS, the Ohio Department of Transportation has just set the final requirements for the design on the project so that the last portion of the design is ready to be completed; and
WHEREAS, the consultant has submitted a fee proposal for this work and funds have been appropriated in the 2013 appropriations to cover this final design work with the remainder being used for appraisals required for right of way acquisition; and
WHEREAS, it is imperative to move forward immediately to meet the deadlines set forth by ODOT for right of way acquisition, and all for the preservation of the public peace, property, health, safety and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the Mayor is hereby authorized to enter into Contract Modification 1 with MS CONSULTANTS, INC., 2221 Schrock Road, Columbus, Ohio 43229, for design services for Hamilton Road Central; proposal attached as EXHIBIT A, and made a part herein.
Section 2. That funding in the amount of SIXTY THOUSAND ONE HUNDRED NINETY ONE DOLLARS ($60,191) was appropriated in the 2013 appropriations to Account No. 325.122.5596, Capital Improvement Fund, to cover the herein costs.
Section 3. That, for the reasons set forth in the preamble hereinabove, this ordinance is declared emergency legislation and shall be in full force and effect immediately upon passage by this Council and on date of signature approval by the Mayor.
