WHEREAS, it is necessary for the Police Department to purchase new tactical armor for the SWAT team as the armor they are currently using is at end of life cycle; and
 
WHEREAS, the Chief of Police has requested that the bidding process be waived and recommended we proceed with purchase from Roy Tailors Uniform Company of Columbus; and
 
WHEREAS, in order to move forward with this purchase it is necessary to appropriate the funds into an expense account; and
 
WHEREAS, the original armor is near the end of its life cycle and replacement should be accomplished as soon as possible, all for the preservation of the public peace, property, health, safety and welfare;
 
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
 
Section 1.  That the amount of FORTY FIVE THOUSAND DOLLARS ($45,000) is hereby supplementally appropriated from the unencumbered, unappropriated balance of the Federal Law Enforcement Trust Fund to Account No. 235.211.5411, FLETF Expense, to cover the herein costs.
 
Section 2.  That ORD-0001-2012, passed January 2, 2012, is hereby amended to reflect this supplemental appropriation.
 
Section 3.  Pursuant to Section 135.05(e)(4) of the Codified Ordinances, the City Attorney has determined, and this Council agrees, that this purchase is of an emergency nature and bidding procedures are hereby waived.
 
Section 4.  That, for the reasons set forth in the preamble hereinabove, this ordinance is declared emergency legislation and shall be in full force and effect after passage by this Council and on date of signature approval by the Mayor.
