ORDINANCE AUTHORIZING THE MAYOR AND DIRECTOR OF PUBLIC SERVICE AND ENGINEERING TO ENTER INTO A LEASE AGREEMENT WITH ZAYO GROUP TO LEASE THE USE OF FIBER, WAIVING THE SECOND READING AND DECLARING IT AN EMERGENCY.

WHEREAS, Zayo group desires to lease the right to use twelve (12) fibers from Gahanna along two (2) separate routes; and,

 

WHEREAS, the term of the lease is for one (1) year with the provision for separate renewals of one (1) month each thereafter; and,

 

WHEREAS, the fibers and system will remain the sole property of the City, but dedicated to Zayo Group’s sole and exclusive use; and,

 

WHEREAS, compensation will be in the form of conduit installation totaling 19,660 feet, of which the City will retain ownership of upon its acceptance; and,

 

WHEREAS, should the lease be renewed, Zayo Group will pay a fee of ten thousand dollars ($10,000) per month through renewal term; and,

 

WHEREAS, it is imperative to move forward with this legislation all for the preservation of the public peace, property, health, safety and welfare;

 

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, COUNTY OF FRANKLIN, STATE OF OHIO:

 

Section 1.  That the Mayor and Director of Public Service and Engineering be and are hereby authorized to enter into a lease agreement with Zayo Group, LLC., 1805 29th Street, Suite 2050, Boulder, CO, 80301, the lease agreement attached as EXHIBIT A, and made a part herein.

 

Section 2.  That the second reading is hereby waived.

 

Section 3. That, for the reasons set forth in the preamble herein above, this Ordinance is declared emergency legislation and shall be in full force and effect after passage by this Council and upon date of signature approval by the Mayor.
