TO ACCEPT FEES IN LIEU OF LAND DEDICATION FOR MEADOWBROOKE DEVELOPMENT; FROM BROOKEWOOD CONSTRUCTION COMPANY.

WHEREAS, the zoning for the Meadowbrooke development on Havens Corners Road was approved by ORD-0017-2007 on February 5, 2007; and
WHEREAS, based on an updated appraisal by Charles R. Porter Company for Brookewood Construction done in 2012, under authority of Section 1109.08(e) of the Codified Ordinances of Gahanna, fees in lieu of land dedication for the currently approved Meadowbrooke development would be $18,472; and
WHEREAS, said fees were delivered to the City on February 25, 2013 and it is desirable to proceed to accept said fees in order that the planning process may continue; and
WHEREAS, written certification, as required in Section 1109.08(h) of the Codified Ordinances of the City of Gahanna, has been received from the Zoning Administrator that all required fee payment requirements under the current zoning have been met by Brookewood Construction Company;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY GAHANNA, STATE OF OHIO:
Section 1. That the amount of EIGHTEEN THOUSAND FOUR HUNDRED SEVENTY TWO DOLLARS ($18,472) is hereby accepted by this Council as the fees in lieu of land dedication for the current zoning for the Meadowbrooke development, and the Administration is authorized to release such permits and certificates as necessary for this development, under authority of Section 1109.08(j).
Section 2. That this ordinance shall be in full force and effect after passage by this Council and 30 days after date of signature approval by the Mayor.
