WHEREAS, ORD-0116-2010 authorized the Mayor to enter into an LPA Agreement with the Ohio Department of Transportation for infrastructure improvements in the City in conjunction with a Safe Routes to Schools grant which has been awarded; and
 
WHEREAS, since this agreement was entered into it has been determined by the Ohio Department of Transportation that in order to meet the federal reimbursement requirements a letter agreement authorizing a consultant contract needs to be signed by the Mayor in order to conform to the federal format; and
 
WHEREAS, it is necessary to proceed immediately so that the project will not be delayed, and all for the preservation of the public peace, property, health, safety and welfare;
 
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
 
Section 1.  That the Mayor is hereby authorized to enter into Letter Agreement with the Ohio Department of Transportation, 1980 West Broad Street, Columbus, Ohio 43223, for Safe Routes to Schools Grant, said letter agreement authorizing a consultant contract with Orchard, Hiltz & McCliment; Letter Agreement attached as EXHIBIT A, and made a part herein.
 
Section 2.  That, for the reasons set forth in the preamble hereinabove, this ordinance is declared emergency legislation and shall be in full force and effect immediately upon passage by this Council and on date of signature approval by the Mayor.
