TO AUTHORIZE THE MAYOR TO ENTER INTO CONTRACT WITH ME COMPANIES FOR APPRAISAL, TITLE WORK NEGOTIATIONS AND RECORDING OF RIGHT OF WAY ACQUISITION FOR PROPERTIES ON OGDEN ALLEY; TO SUPPLEMENTALLY APPROPRIATE $18,250; AND TO DECLARE AN EMERGENCY.

WHEREAS, the City is in need of right of way acquisition for the Ogden Alley improvement, to include appraisal, title work negotiations and recording; and
WHEREAS, the City Engineer has recommended that we proceed with ME Companies; and
WHEREAS, money was appropriated in the 2001 Appropriations, but the project did not move forward in a timely manner, and was not spent and is being returned to the General Fund; and
WHEREAS, it is desirable and prudent to effect this contract at the earliest possible date all for the preservation of the public peace, health, safety and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the Mayor is hereby authorized to enter into contract with ME Companies, 635 Brooksedge Boulevard, Westerville, Ohio 43081, for right of way acquisition services for the Ogden Alley Improvement No. 774.
Section 2. That funding in the amount of EIGHTEEN THOUSAND TWO HUNDRED FIFTY DOLLARS ($18,250) is hereby supplementally appropriated from the unencumbered, unappropriated balance of the General Fund to Account No. 101.145.5533, Capital Projects, Engineering, to cover the herein costs.
Section 3. That ORD-0001-2002, passed January 2, 2002, is hereby amended to reflect this supplemental appropriation.
Section 4. That, for the reasons set forth in the preamble herein above, this ordinance is declared emergency legislation, and shall be in full force and effect immediately upon passage by this Council and on date of signature approval by the Mayor.
