TO AUTHORIZE THE MAYOR TO ENTER INTO FINAL CHANGE ORDER AGREEMENT WITH M. J. EXCAVATING, LTD., FOR THE CHERRYBOTTOM ROAD WATERLINE, IMPROVEMENT NO. 741; TO SUPPLEMENTALLY APPROPRIATE $5,227; AND TO DECLARE AN EMERGENCY.

WHEREAS, the Cherrybottom Road Waterline, Imp. No. 741 is near completion and there were several change orders during the construction; and
WHEREAS, it is imperative to proceed all for the preservation of the public peace, health, safety and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the Mayor is hereby authorized to enter into change order Agreement with M.J. EXCAVATING, LTD, P.O. Box 426, Sugarcreek, Ohio 44681, for the Cherrybottom Road Waterline, Improvement No. 741, in accordance with proposal attached as EXHIBIT A.
Section 2. That funding in the amount of Five Thousand Two Hundred Twenty Seven Dollars ($5,227) is hereby supplementally appropriated from the WSCI Fund, to Account No. 652.351.5596, Misc. Water Improvement, to cover the herein costs.
Section 3. That ORD-0001-2002, passed January 2, 2002, is hereby amended to reflect this supplemental appropriation.
Section 4. That, for the reasons set forth in the preamble herein above, this ordinance is declared emergency legislation and will be in full force and effect immediately upon passage by this Council and on date of signature approval by the Mayor.
