TO AUTHORIZE THE MAYOR TO ENTER INTO CONTRACT AGREEMENT FOR THE 1999 FISCAL YEAR WITH THE FRANKLIN COUNTY PUBLIC DEFENDER COMMISSION TO REPRESENT INDIGENT PERSONS BEFORE THE FRANKLIN COUNTY MUNICIPAL COURT CHARGED WITH VIOLATIONS UNDER GAHANNA ORDINANCES; AND TO DECLARE AN EMERGENCY.

WHEREAS, pursuant to Ohio Revised Code, Section 120.14(E), the City may authorize the Franklin County Municipal court to represent indigent persons before Franklin County Municipal Court charged under Gahanna ordinances; and

 

WHEREAS, a contract should be entered into beginning January 1, 2000, and it is prudent, therefore, for the continuing effectiveness of this program, to effect this contract by said beginning date, all for the preservation of the public peace, health, safety, and welfare;

 

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:

 

Section 1.  That the Mayor is hereby authorized to enter into Contract with Franklin County Public Defender Commission for the representation of indigent persons coming before the Franklin County Municipal Court, Criminal Division, charged with a violation of an ordinance of the City of Gahanna, said Contract attached to this ordinance as EXHIBIT A, and made a part herein.

 

Section 2.  That the amount of Three Thousand Five Hundred Dollars will be set aside in the 2000 Appropriations to cover the herein costs

 

Section 3.  That, for the reasons set forth in the preamble herein above, this ordinance is declared emergency legislation and shall be in full force and effect immediately after passage by this Council and upon date of signature approval by the Mayor.
