TO AUTHORIZE THE MAYOR TO ENTER INTO AMENDED REIMBURSEMENT AGREEMENT WITH DONALD R. KENNEY FOR CONSTRUCTION OF EAST INDUSTRIAL SANITARY SEWER, IMPROVEMENT NO. 727, TO INCLUDE CONSTRUCTION OF THE TEMPORARY PUMP STATION, IMPROVEMENT NO. 761; TO SUPPLEMENTALLY APPROPRIATE $225,000 THEREFOR; AND TO DECLARE AN EMERGENCY.

WHEREAS, Donald R. Kenney is constructing the East Industrial Sanitary Sewer, Improvement No. 727 under the authority of the reimbursement agreement approved by Ordinance 990326; and
WHEREAS, Donald R. Kenney is also going to construct the Temporary Pump Station, according to plans and specifications in the City Engineer's office designated as Improvement No. 761, and additional funding must be appropriated for this improvement; and
WHEREAS, it is imperative to move forward with the construction of the East Industrial Sanitary Sewer as well as the pump station, all for the preservation of the public, peace, health, safety and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the Mayor is hereby authorized to enter into amended Reimbursement Agreement with Donald R. Kenney for construction of the East Industrial Sanitary Sewer and the Temporary Pump Station, Improvement No. 761, said agreement attached hereto as EXHIBIT A.
Section 2. That the amount of TWO HUNDRED TWENTY FIVE THOUSAND DOLLARS ($225,000) is hereby supplementally appropriated from the unappropriated, unencumbered balance in the SSCI Fund, to Account No. 662.361.5821, Capital Project, Sewer TIF, to cover the herein costs.
Section 3. That ORD-1-2000, passed January 3, 2000, is hereby amended to reflect this supplemental appropriation.
Section 4. That, for the reasons set forth in the preamble herein above, this ordinance is declared emergency legislation and shall be in full force and effect immediately upon passage by this Council and on date of signature approval by ...
