WHEREAS, The Columbus & Ohio River Rail Road has approached the City about taking over the maintenance and inspection of the City of Gahanna owned industrial railroad tracks in return for the exclusive right to provide railroad service on said tracks, and has provided the City with a Private Sidetrack Agreement, and the City Engineer and the Director of Development have recommended that we accept this agreement;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the Mayor is hereby authorized to enter into agreement with THE COLUMBUS & OHIO RIVER RAIL ROAD COMPANY, 136 South Fifth Street, Coshocton, Ohio, 43812, for maintenance and inspection of the Gahanna owned industrial railroad tracks; Private Sidetrack Agreement attached and made a part of this ordinance as EXHIBIT A.
Section 2. That this ordinance will be in full force and effect after passage by this Council and 30 days after signature of approval by the Mayor.
