TO AUTHORIZE THE MAYOR TO ENTER INTO ADDENDUM AGREEMENT WITH PEN-LOR ENTERPRISES, INC., FOR OPERATION AND MAINTENANCE OF THE CITY FUEL FACILITY, SCIENCE BOULEVARD; AND TO DECLARE AN EMERGENCY.

WHEREAS, The City currently contracts with Pen-Lor Enterprises for the operation and maintenance of our fuel facility; and
WHEREAS, it has been determined that an intense review of all options available to the City concerning maintaining our fuel site be explored; and
WHEREAS, Pen-Lor has agreed to extend the current contract by Addendum 2 until December 31, 2003; AND
WHEREAS, it is imperative to move forward with this ordinance all for the preservation of the public peace, health, safety and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the Mayor is hereby authorized to enter in extended agreement, Addendum 2, with Pen-Lor Enterprises, Inc., P.O. Box 148, Millersburg, Ohio 44654, for maintenance and operation of the City fuel facility; Addendum 2 attached and made a part of this ordinance.
Section 2. That this Addendum will assure coverage by Pen-Lor until December 31, 2003.
Section 3. That, for the reasons set forth in the preamble herein above, this ordinance is declared emergency legislation and shall be in full force and effect immediately after passage by this Council and on date of signature approval by the Mayor.
