TO AUTHORIZE THE MAYOR TO ENTER INTO CONTRACT WITH ZUBER LANDSCAPE DESIGN CONSTRUCTION INC. FOR THE CHERRYBOTTOM ROAD RETAINING WALL, TO SUPPLEMENTALLY APPROPRIATE $13,000 THEREFOR; AND TO DECLARE AN EMERGENCY

WHEREAS, it has been requested by the City Engineer that work be done on a retaining wall along a portion of Cherrybottom Road; and
WHEREAS, letter proposal for the construction of this retaining wall, dated October 23, 2001, has been received and has been recommended by the City Engineer; and
WHEREAS, the toe of the hillside slope was disturbed by the installation of the Cherrybottom Road water line; and
WHEREAS, it is necessary to move forward with this project in a timely fashion to prevent damage to the bikepath and the Cherrybottom Road base; all for the preservation of the public peace, health, safety and welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:
Section 1. That the Mayor is hereby authorized to enter into Contract with Zuber Landscape Design Construction, Inc., 1771 Harmon Road, Columbus, Ohio 43223, for construction of a segmental block retaining wall along a portion of Cherrybottom Road, said services to be in accordance with proposal letter, dated October 23, 2001, attached hereto as EXHIBIT A, and all in accordance with City specifications.
Section 2. That funding in the amount of THIRTEEN THOUSAND DOLLARS ($13,000) is hereby supplementally appropriated from the unappropriated, unencumbered funds in the Water Fund to Account No. 652.351.5596, WSCI, to cover the herein costs.
Section 3. That ORD-0001-2001, passed January 2, 2001, is hereby amended to reflect this supplemental appropriation.
Section 4. That, for the reasons set forth in the preamble hereinabove, this ordinance is declared emergency legislation and shall be in full force and effect after passage by this Council and on the date of signature approval by the Mayor.
