TO VOICE COUNCIL'S ADAMANT OPPOSITION TO HOUSE BILL 258

WHEREAS, H.B. 258 has been introduced in the 124th general Assembly which, by proposed Section 3.19 of the Ohio Revised Code, would prohibit all municipalities from imposing residency restrictions on their employees; and

 

WHEREAS, the bill's attempt to substitute the General Assembly's judgment for the judgment of the voters of the City of Gahanna as well as Gahanna City Council violates the home rule powers given to the City of Gahanna by Section 3 Article XVIII of the Ohio Constitution which has been in effect since 1912;

 

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF GAHANNA, STATE OF OHIO:

 

Section 1.  That Council hereby vehemently expresses its opposition to H.B. 258 and specifically requests that every legislator in the Ohio General Assembly vote against H.B. 258 so that municipalities may continue to exercise their constitutional right to determine what, if any, employee residency requirements are in the best interest of each municipality.

 

Section 2.  That this Council hereby respectfully requests, both in regard to H.B. 258 and all other matters of local concern, that the Ohio General Assembly respect and give deference to the right of local self government granted to municipalities by the home rule powers given municipalities in Section 3 Article XVIII of the Ohio Constitution.

 

Section 3.  That this resolution be submitted to the Ohio General Assembly.

 

Section 4.  That this resolution shall be in full force and effect immediately after passage by this Council.
